Topics will include copyright essentials for musicians, a look at music publishing and Performing Rights Organizations (PROs), music licensing, understanding recording and publishing contracts, and music clearances for the use of music in film, TV, digital projects, and more.

Artists, Activists, and Outlaws: The History and Future of Free Expression

Please join Oregon Volunteer Lawyers for the Arts for a workshop exploring the history of the First Amendment in the arts. 

The history of free expression was written by artists and activists who dared to push the boundaries of what society was ready to hear. In the process, many of them were branded as outlaws and forced to fight their way through the justice system. 

This workshop will take a tour through some of the biggest and most explosive First Amendment cases of the last fifty years, discuss the ground rules for free expression in 2019, and then jump forward to discuss a variety of looming issues for the years to come, including free speech on the Internet, the interaction between digital art and political warfare, and censorship in an age where the lines between private corporations and governments get murkier every day.

Copyright Fundamentals for Creatives

Oregon Volunteer Lawyers for the Arts in partnership with the Regional Arts & Culture Council, presents Copyright Fundamentals for Creatives. 

This workshop provides valuable information on the fundamentals of basic copyright protection, including copyright ability of works, ownership (initial ownership; transfers; works-for-hire), registration, infringement and remedies, and fair use. Through this workshop you will gain a basic understanding of copyright law and learn how to protect your work.

Presenter: 

Kohel Haver received his JD from the Northwestern Law School at Lewis & Clark College, and he is currently a partner at Swider Haver LLP. Haver practices in the areas working with creative people and the arts, including a specialty in copyright and related intellectual property, technology, and business law. He has been serving the arts community for all of his professional life, including service on the boards of directors for community and arts based programs nationwide.

Oregon Volunteer Lawyers for the Arts (in partnership with the Regional Arts & Culture Council) presents this seminar about the basics of contracts for artists. This workshop will walk you through important contract clauses, how to negotiate those clauses effectively, and best practices to avoid finding yourself in contract litigation. Whether you are a painter, performer, or writer, this workshop will explore the elements of a succesful contract. 

Cost: $15.

Presenters:

Sean Clancy is an attorney whose practice focuses on business and intellectual property (“IP”).  As outside IP counsel for a variety of innovative industries including state-licensed cannabis, entertainment media, design, consumer products, food, beverages, professional services, software, and new technology, Sean advises on state and federal trademark rights, copyrights, publicity, privacy, trade secrets, non-disclosure agreements, and licensing.  As general business and corporate counsel, Sean negotiates, prepares legal documents, and advises on relationships spanning from entity formation and ordinary business to complex transactions and disputes.  Before becoming an attorney, Sean was a filmmaker in Seattle.

Tricia Juettemeyer is senior corporate counsel at a software company headquartered in Portland. Prior to this Tricia was an intellectual property and business attorney at a law firm in Portland. She took a winding path to the law, starting with art school, working in post-production, heading to library school, working for many years as an academic librarian, along the way learning about copyright, eventually leading her to law school. Tricia has advised clients in the area of copyright law, trademark law, contracts, and more, and currently advises broadly on business and intellectual property matters. An educator as well as an attorney, Tricia taught Business Associations as an adjunct professor for the University of Oregon law school, and will teach an intellectual property for business course to undergraduates at Lewis & Clark College next spring.

SECOND MONDAY WORKSHOP: ESTATE PLANNING 101 FOR CREATIVES

Wills, Living Trusts, Powers of Attorney, beneficiary designations, and Health Directives are the core components of any estate plan, regardless of an individual’s wealth. Without these in place, you may be foregoing control over assets, end-of-life medical decisions, and what becomes of your artistic legacy.

In this workshop, OVLA will provide an overview of estate planning concepts, the documents involved and what they accomplish, and will touch on considerations unique to artists that must be addressed in their estate planning.

Additional topics will include:

Who controls your health care and financial decisions if you become incapacitated?

What happens if you die without a will?

What is probate?

Will an estate tax be owed upon your death?
